By accessing and using AdaptTrack ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

AdaptTrack provides hearing aid trial management software for audiology clinics in the United States. Our Service includes:

  • Automated SMS check-ins for hearing aid trial patients
  • Patient trial tracking dashboard
  • Staff login access and management tools
  • Trial scheduling and monitoring features

3. Eligibility

The Service is intended for use by licensed audiology clinics and healthcare providers in the United States. By using the Service, you represent that you are authorized to enter into this agreement on behalf of your clinic or practice.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Ensure staff members with access to your account comply with these Terms

5. Payment and Subscription

AdaptTrack is offered at $79 per month per clinic location. Payment terms include:

  • Monthly billing on a recurring basis
  • No long-term contracts required
  • Cancellation permitted at any time
  • Fees are non-refundable except as required by law
  • We reserve the right to modify pricing with 30 days notice

6. Patient Data and Consent

As the clinic or healthcare provider using AdaptTrack, you are responsible for compliance with all applicable laws and regulations regarding patient communications and data. You represent and warrant that:

  • You have obtained appropriate patient consent for SMS communications
  • You will only enter patient information you are authorized to use
  • You comply with all applicable privacy and telecommunications laws
  • You understand that AdaptTrack is a communication and tracking tool, not a medical records system

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited messages
  • Share your account credentials with unauthorized parties
  • Reverse engineer or attempt to extract source code from the Service

8. SMS Communications

By using our automated SMS features, you acknowledge that:

  • You are responsible for obtaining patient consent to receive SMS messages
  • Standard SMS rates may apply to your patients
  • SMS delivery is dependent on mobile carriers and not guaranteed
  • You must provide patients with opt-out instructions

9. Intellectual Property

The Service, including all software, content, designs, and trademarks, is owned by AdaptTrack and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAPTTRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will cease
  • You remain responsible for any outstanding fees
  • You may request export of your data within 30 days of termination
  • We reserve the right to delete your data after the retention period

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by the laws of the United States and the state in which AdaptTrack is incorporated, without regard to conflict of law provisions.
